App 服务条款（用户协议）

本服务条款（以下简称“本协议”）是您与 深圳市物通融合科技有限公司（以下简称“我们”）之间就使用 BSLBATTERY 应用（以下简称“本应用”）服务所订立的协议。本应用由我们开发、分发并运营。
一、协议的确认与接受
1.1 本协议是您与本应用之间就使用本应用服务所订立的协议。
1.2 本应用由深圳市物通融合科技有限公司开发、分发并运营。
1.3 您在注册账号、登录或使用本应用服务前，应当认真阅读并充分理解本协议全部内容。您点击“同意”或实际使用本应用服务，即视为您已阅读并同意接受本协议的全部约定。如您不同意本协议的任何内容，请立即停止注册或使用本应用。
1.4 您确认，您已年满 13 周岁，具备相应的民事行为能力。如您未满 18 周岁，请在监护人的陪同下阅读本协议，并在取得监护人同意后使用本应用。
二、服务内容
2.1 本应用为您提供以下服务（以下简称“本服务”）：
- BMS设备的运行状态监控与数据查询；
- 站点创建、管理与站点图片上传；
- 通过蓝牙连接设备，进行设备配网（WiFi 配置）、参数设置；
- 通过蓝牙为设备进行固件升级（OTA）；
- 消息通知与账户管理服务。
2.2 您理解并同意，本服务的部分功能依赖于您的终端设备与您所管理的硬件设备之间的蓝牙或网络连接，相关功能可能因设备型号、系统版本、网络环境不同而存在差异。
2.3 我们有权根据产品运营需要，对服务内容进行调整、增加或终止部分功能，并通过应用内公告等方式通知您。
三、账号与安全
3.1 您需要使用有效的邮箱地址注册账号，并通过邮箱验证码完成验证。您应当妥善保管账号与密码，因您主动泄露账号密码或遭受他人攻击导致的损失，由您自行承担。
3.2 您的账号仅限您本人使用，不得赠与、借用、租用、转让或售卖。如发现账号被盗用或存在安全漏洞，应立即通过 pengzhuang@wutongronghe.com 通知我们。
3.3 您可以通过本应用内的注销功能（我的 → 设置 → 注销账号）或发送邮件至 pengzhuang@wutongronghe.com 申请注销账号，也可以访问 https://bms.bslbatt.org/deleteRequest.html 提交申请删除账号或数据。账号注销后，您的个人信息将按《隐私政策》的约定删除，且无法恢复。
四、用户行为规范
4.1 您在使用本服务时，不得从事以下行为：
- 违反任何适用的法律法规、政策或公序良俗的行为；
- 对本应用进行反向工程、反向编译，或试图获取本应用源代码（法律法规明确允许的除外）；
- 未经授权访问、干扰、破坏本应用的服务器、网络或与之连接的设备；
- 利用本服务上传、传播含有病毒、木马或其他恶意程序的内容；
- 上传侵犯他人知识产权、肖像权、隐私权等合法权益的图片或其他内容；
- 冒充他人或伪造身份注册、使用本服务；
- 其他任何损害我们或第三方合法权益的行为。
4.2 如您违反上述约定，我们有权视情节轻重，对您采取警告、限制功能、暂停或终止提供服务等措施，并保留追究法律责任的权利。
五、知识产权
5.1 本应用及其所包含的软件、界面设计、文字、图片、商标（包括但不限于“BSLBATTERY”标识）等知识产权，归我们或相应的权利人所有，受法律保护。
5.2 我们授予您一项个人的、非排他的、不可转让的、有限的许可，仅供您在合法拥有的终端设备上为个人非商业目的使用本应用。
5.3 您上传的头像、站点图片等内容的权利归您或原权利人所有。您授予我们一项为提供本服务所必需的、免费的、非排他的使用许可，仅用于存储、展示和传输您所上传的内容。
六、免责声明
6.1 本应用所展示的设备运行数据来源于您所管理的硬件设备上报，仅供参考。我们不对数据的实时性、绝对准确性作保证。涉及设备安全运行的关键操作，请以设备现场的实际情况和专业人员的判断为准。
6.2 因下列情形导致的服务中断或数据异常，我们不承担责任，但将尽力减少对您的影响：
- 不可抗力（自然灾害、战争、政府行为等）；
- 网络故障、电信运营商或云服务提供商（AWS）的原因；
- 您的终端设备、蓝牙、WiFi 环境或被管理硬件设备的故障；
- 您的不当操作或账号密码泄露；
- 我们事先公告的系统维护、升级。
6.3 固件升级（OTA）过程中，请您确保设备电量充足、连接稳定。因升级过程中断电、断连等非因本应用原因导致的设备异常，我们不承担责任。
6.4 在适用法律允许的最大范围内，本应用按“现状”和“可获得”的基础提供，我们不对本服务作出任何明示或默示的担保。
七、协议的变更与终止
7.1 我们有权根据法律法规变化或产品运营需要修改本协议。修改后的协议将在本应用内公布，重大变更我们将以显著方式通知您。若您不同意修改后的协议，应停止使用本服务并注销账号；若您继续使用本服务，则视为接受修改后的协议。
7.2 出现下列情形之一的，本协议终止：
- 您注销账号；
- 您严重违反本协议，我们终止向您提供服务；
- 我们终止运营本应用（将提前公告）。
7.3 本协议终止后，我们将按照《隐私政策》处理您的个人信息。
八、法律适用与争议解决
8.1 本协议的订立、执行、解释及争议的解决均适用中华人民共和国法律（为本协议之目的，不含港澳台地区法律），并排除冲突法规则的适用。
8.2 因本协议产生的或与本协议有关的任何争议，双方应首先友好协商解决；协商不成的，任何一方均可向本公司所在地有管辖权的人民法院提起诉讼。

App Terms of Service (User Agreement)

These Terms of Service (the "Agreement") are entered into between you and Shenzhen Wutong Ronghe Technology Co., Ltd. ("we", "us" or "our") regarding your use of the BSLBATTERY application (the "App"). The App is developed, distributed and operated by us.
1. Acceptance of the Agreement
1.1 This Agreement governs your use of the services provided by the App.
1.2 The App is developed, distributed and operated by Shenzhen Wutong Ronghe Technology Co., Ltd.
1.3 Before registering an account, logging in or using the App's services, you should read and fully understand this Agreement. By tapping "Agree" or actually using the App's services, you are deemed to have read and accepted all terms of this Agreement. If you do not agree with any part of this Agreement, please stop registering or using the App immediately.
1.4 You confirm that you are at least 13 years old and have the corresponding legal capacity. If you are under 18, please read this Agreement together with your guardian and use the App only with your guardian's consent.
2. Services
2.1 The App provides you with the following services (the "Services"):
- Monitoring and data query of BMS devices;
- Site creation, management and site photo upload;
- Connecting to devices via Bluetooth for network provisioning (WiFi configuration) and parameter settings;
- Firmware upgrade (OTA) for devices via Bluetooth;
- Message notifications and account management services.
2.2 You understand and agree that certain features of the Services depend on the Bluetooth or network connection between your terminal device and the hardware devices you manage, and such features may vary depending on device model, system version and network environment.
2.3 We reserve the right to adjust, add or discontinue certain features of the Services based on product operation needs, and will notify you through in-app announcements or other means.
3. Account and Security
3.1 You need to register an account with a valid email address and complete verification via an email verification code. You should keep your account and password safe. Losses caused by your voluntary disclosure of your account password or attacks by others shall be borne by you.
3.2 Your account is for your personal use only and may not be gifted, lent, rented, transferred or sold. If you find that your account has been misappropriated or has any security vulnerability, please notify us immediately at pengzhuang@wutongronghe.com.
3.3 You may request account deletion through the in-app deletion feature (Profile → Settings → Delete Account) or by emailing pengzhuang@wutongronghe.com, or you may visit https://bms.bslbatt.org/deleteRequest.html to submit a request to delete your account or data. Once your account is deleted, your personal information will be deleted in accordance with the Privacy Policy and cannot be recovered.
4. User Conduct
4.1 When using the Services, you shall not engage in any of the following:
- Any conduct that violates applicable laws, regulations, policies or public order and morals;
- Reverse engineering or decompiling the App, or attempting to obtain the App's source code (except as expressly permitted by law);
- Unauthorized access to, interference with, or damage to the App's servers, networks or devices connected to them;
- Using the Services to upload or spread content containing viruses, trojans or other malicious programs;
- Uploading images or other content that infringes others' intellectual property rights, portrait rights, privacy rights or other legitimate rights;
- Impersonating others or registering/using the Services with a false identity;
- Any other conduct that harms the legitimate rights and interests of us or any third party.
4.2 If you violate the above provisions, we reserve the right, depending on the severity, to warn you, restrict features, suspend or terminate the Services provided to you, and reserve the right to pursue legal liability.
5. Intellectual Property
5.1 The intellectual property rights of the App and the software, interface design, text, images and trademarks it contains (including but not limited to the "BSLBATTERY" logo) are owned by us or the corresponding rights holders and are protected by law.
5.2 We grant you a personal, non-exclusive, non-transferable and limited license to use the App on terminal devices you legally own, solely for personal non-commercial purposes.
5.3 The rights to the content you upload, such as avatars and site photos, belong to you or the original rights holders. You grant us a free, non-exclusive license necessary for providing the Services, solely for storing, displaying and transmitting the content you upload.
6. Disclaimers
6.1 The device operation data displayed in the App is reported by the hardware devices you manage and is for reference only. We make no guarantee as to the real-time nature or absolute accuracy of the data. For critical operations involving the safe operation of devices, please rely on the actual on-site conditions of the devices and the judgment of qualified professionals.
6.2 We shall not be liable for service interruptions or data anomalies caused by the following circumstances, but will endeavor to minimize the impact on you:
- Force majeure (natural disasters, war, government actions, etc.);
- Network failures, or causes attributable to telecom carriers or the cloud service provider (AWS);
- Malfunctions of your terminal device, Bluetooth, WiFi environment or the managed hardware devices;
- Your improper operation or disclosure of your account password;
- System maintenance or upgrades announced by us in advance.
6.3 During firmware upgrade (OTA), please ensure that the device has sufficient power and a stable connection. We shall not be liable for device abnormalities caused by power failure, disconnection or other reasons not attributable to the App during the upgrade process.
6.4 To the maximum extent permitted by applicable law, the App is provided on an "as is" and "as available" basis, and we make no express or implied warranties regarding the Services.
7. Modification and Termination
7.1 We reserve the right to modify this Agreement based on changes in laws and regulations or product operation needs. The modified Agreement will be published in the App, and we will notify you of material changes in a prominent manner. If you do not agree with the modified Agreement, you should stop using the Services and delete your account; if you continue to use the Services, you are deemed to have accepted the modified Agreement.
7.2 This Agreement shall terminate upon any of the following:
- You delete your account;
- You materially breach this Agreement and we terminate the Services provided to you;
- We cease operating the App (with prior announcement).
7.3 Upon termination of this Agreement, we will process your personal information in accordance with the Privacy Policy.
8. Governing Law and Dispute Resolution
8.1 The formation, performance, interpretation and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China (for the purposes of this Agreement, excluding the laws of Hong Kong, Macau and Taiwan), excluding the application of conflict-of-law rules.
8.2 Any dispute arising from or in connection with this Agreement shall first be resolved through friendly negotiation; if negotiation fails, either party may file a lawsuit with the competent people's court where our company is located.
